hindered by the presence 00:06:40.490 --> 00:06:43.350 or potential presence of contamination. 00:06:43.350 --> 00:06:44.500 And there it's really important 00:06:44.500 --> 00:06:47.720 to focus on presence or potential presence. 00:06:47.720 --> 00:06:50.330 So you might not know if there's contamination. 00:06:50.330 --> 00:06:53.620 And that could be what's kind of limiting 00:06:55.090 --> 00:06:56.710 redevelopment of that property. 00:06:56.710 --> 00:07:00.370 And so these brownfields are typically gonna be eyesores 00:07:00.370 --> 00:07:02.850 in your community, they've probably been there 00:07:02.850 --> 00:07:04.820 for a long time, and the reason 00:07:04.820 --> 00:07:06.290 why they've probably been there for a long time 00:07:06.290 --> 00:07:08.550 is because there's a potential hazard 00:07:08.550 --> 00:07:12.050 or potential contamination, which has made it, so the city 00:07:12.050 --> 00:07:14.140 or any private developers just don't really wanna 00:07:14.140 --> 00:07:16.540 take it on, don't want to deal with that liability 00:07:16.540 --> 00:07:18.240 or anything like that. 00:07:18.240 --> 00:07:22.290 And so what the Brownfields Program is, 00:07:22.290 --> 00:07:25.040 is a grant funded program that provides 00:07:25.040 --> 00:07:28.230 free site assessments and the Railroad Commission 00:07:28.230 --> 00:07:32.040 case cleanups of those brownfields properties. 00:07:32.040 --> 00:07:36.130 And so we're gonna provide that service 00:07:36.130 --> 00:07:38.910 for local government entities, 00:07:38.910 --> 00:07:42.430 nonprofit economic development groups, 00:07:42.430 --> 00:07:46.333 universities and schools and Federally Recognized Tribes. 00:07:47.210 --> 00:07:52.210 And then, this last one we really don't have many of them, 00:07:53.000 --> 00:07:56.840 but there are cases where we will accept private landowners 00:07:56.840 --> 00:07:58.950 with the community support. 00:07:58.950 --> 00:08:01.370 But there I think it's important that the community 00:08:01.370 --> 00:08:03.410 is going to be the applicant, 00:08:03.410 --> 00:08:06.380 and they're applying on behalf of that private landowner 00:08:06.380 --> 00:08:08.120 or even private developer. 00:08:08.120 --> 00:08:11.233 And there has to be some sort of community support there. 00:08:12.760 --> 00:08:14.200 All right. 00:08:14.200 --> 00:08:16.713 And so why is this program important? 00:08:18.190 --> 00:08:21.563 What should you take away from this at the end? 00:08:22.570 --> 00:08:27.210 So this program, it really, when you investigate 00:08:27.210 --> 00:08:31.380 and remediate these sites, and get them to the point 00:08:31.380 --> 00:08:34.183 where you can actually start developing them, 00:08:35.040 --> 00:08:38.910 you're going to increase your tax base in that area. 00:08:38.910 --> 00:08:42.000 You're gonna create potentially new jobs with that. 00:08:42.000 --> 00:08:43.330 And you're gonna kick start 00:08:43.330 --> 00:08:47.030 some other community revitalization activities. 00:08:47.030 --> 00:08:50.380 All by just kind of tackling that one bad site 00:08:50.380 --> 00:08:52.130 that's been an eyesore for years, 00:08:52.130 --> 00:08:55.790 and it had contamination and it was potentially causing 00:08:55.790 --> 00:08:58.360 the entire area just not to be redeveloped. 00:08:58.360 --> 00:09:01.310 So there's big incentives to be part of this program, 00:09:01.310 --> 00:09:05.703 and to help your community by going through this. 00:09:07.870 --> 00:09:10.850 So program eligibility. 00:09:10.850 --> 00:09:13.960 So this is kind of a really important part. 00:09:13.960 --> 00:09:15.240 You need to be a qualified applicant. 00:09:15.240 --> 00:09:17.750 That's what we previously talked about. 00:09:17.750 --> 00:09:21.750 So that's gonna be your local government entities, 00:09:21.750 --> 00:09:26.750 universities, schools, economic development groups. 00:09:26.890 --> 00:09:29.640 And then you need a redevelopment plan. 00:09:29.640 --> 00:09:32.300 The redevelopment plan, you don't have to stick strictly 00:09:32.300 --> 00:09:34.440 to it, but you need to have some idea 00:09:34.440 --> 00:09:36.670 of what you're gonna do with the property afterwards. 00:09:36.670 --> 00:09:39.620 And it should have some sort of community benefit, 00:09:39.620 --> 00:09:42.573 whether that's creation of jobs, green space, 00:09:43.570 --> 00:09:45.723 increased tax revenues, things like that. 00:09:47.760 --> 00:09:50.560 And so then for the Railroad Commission, 00:09:50.560 --> 00:09:52.920 for the property to be eligible, 00:09:52.920 --> 00:09:55.763 the oil and gas operations on that property 00:09:55.763 --> 00:09:59.410 need to be abandoned, and there cannot be a responsible 00:09:59.410 --> 00:10:01.320 party for clean up. 00:10:01.320 --> 00:10:04.030 But here I think it's also important to know 00:10:04.030 --> 00:10:06.250 that the Railroad Commission will not hold 00:10:06.250 --> 00:10:09.330 innocent landowners responsible for cleanup. 00:10:09.330 --> 00:10:12.130 So don't let that kind of be an issue 00:10:12.130 --> 00:10:13.753 for bringing the site to us. 00:10:14.730 --> 00:10:16.980 Also there can be unresolved federal 00:10:16.980 --> 00:10:19.063 or state enforcement on the property. 00:10:20.070 --> 00:10:24.250 And then the applicant and landowner agree to cooperate 00:10:24.250 --> 00:10:25.910 with the Railroad Commission. 00:10:25.910 --> 00:10:28.590 And here I think it's important to point be purchasing the property in a couple 00:10:37.120 --> 00:10:41.493 of years or have some other plans. 00:10:42.690 --> 00:10:45.670 But you just have to have the landowners permission 00:10:45.670 and gas exploration 00:11:09.990 --> 00:11:13.850 and production, transportation of oil, gas 00:11:13.850 --> 00:11:18.390 and liquefied natural gas pipeline, natural gas processing, 00:11:18.390 --> 00:11:23.390 salt film cavern storage, prime mining of oil, gas and LNG, 00:11:25.390 --> 00:11:27.140 bulk storage of crude oil, 00:11:27.140 --> 00:11:29.143 and then commercial disposal facilities. 00:11:31.410 --> 00:11:32.850 And if you want more information 00:11:32.850 --> 00:11:35.530 on kind of the jurisdictional divide 00:11:35.530 --> 00:11:37.830 between the Railroad Commission and 00:12:32.670 and gas property, oil and gas activities on your property. 00:12:32.670 --> 00:12:35.800 And so here we're gonna go through three helpful tips 00:12:35.800 --> 00:12:38.880 to help you determine this, and whether or not your site 00:12:38.880 --> 00:12:40.340 might qualify specifically 00:12:40.340 --> 00:12:43.303 for the Railroad Commission's Brownfields Program. 00:12:47.240 --> So one thing you can do this with is again, 00:14:28.670 --> 00:14:30.990 take a tour of the property, look out for things 00:14:30.990 --> 00:14:35.990 like oil drums, disposal pits, pump jacks, the Brownfields Program, 00:19:21.310 --> 00:19:25.590 and then also received funding from Texas Parks and Wildlife 00:19:25.590 --> 00:19:29.323 to restore this area and put in these trails, 00:19:30.330 --> 00:19:33.963 and all their boardwalks and birdhouses. 00:19:36.600 --> 00:19:41.380 So the investigations that occurred at the site. 00:19:41.380 --> 00:19:45.093 We got the application in 2000, 2003, 2004, 00:19:46.970 --> 00:19:48.620 and we immediately started working 00:19:48.620 --> 00:19:51.020 on phase one and phase two. 00:19:51.020 --> 00:19:55.120 Obviously we found as mentioned the leaking loading tanks 00:19:55.120 --> 00:19:56.453 and the disposal pit. 00:19:57.380 --> 00:20:01.500 We gauged and sampled the tanks to determine 00:20:01.500 --> 00:20:04.860 what was in them and how much product was remaining. 00:20:04.860 --> 00:20:08.170 We removed that product and disposed of it. 00:20:08.170 --> 00:20:12.240 We also collected soil samples and installed temporary 00:20:12.240 --> 00:20:15.410 monitoring walls throughout the site. 00:20:15.410 --> 00:20:18.690 We also conducted a naturally occurring 00:20:18.690 --> 00:20:21.113 radiation monitors survey. 00:20:22.190 --> 00:20:25.203 And so that was kind of based on the age of the tanks. 00:20:26.190 --> 00:20:29.280 Based on that NORM survey we found one of the tanks 00:20:29.280 --> 00:20:30.820 did have NORM. 00:20:30.820 --> 00:20:34.210 And so one cool thing about this site, 00:20:34.210 --> 00:20:37.130 the city of Andrews and a local company actually helped us 00:20:37.130 --> 00:20:39.660 dispose of all the tanks on the site, 00:20:39.660 --> 00:20:43.530 including the NORM tank that needed special disposal. 00:20:43.530 --> 00:20:45.860 So that was, I think it ended up saving 00:20:45.860 --> 00:20:49.283 the Commission around $7,500, which was great. 00:20:51.660 --> 00:20:55.950 And then based on the soil samples we collected at the site 00:20:55.950 --> 00:20:59.550 we found some impacted soils around the tanks and pits. 00:20:59.550 --> 00:21:02.450 And so we excavated soils in that area 00:21:02.450 --> 00:21:03.700 and disposed of them off. 00:21:04.713 --> 00:21:07.396 And then in 2006 the city managers received 00:21:07.396 --> 00:21:10.896 a certificate of completion for this site. 00:21:13.292 --> 00:21:15.570 So this one, I like to start out with this one, 00:21:15.570 --> 00:21:20.570 because it's really great example of using this brownfields 00:21:22.370 --> 00:21:26.690 funding for a very large redevelopment. 00:21:26.690 --> 00:21:30.980 And so in the picture above the aerial image 00:21:30.980 --> 00:21:35.980 we have a small black, a small red square, 00:21:36.601 --> 00:21:40.300 that is the actual four acres brownfield site. 00:21:40.300 --> 00:21:44.130 So that is where we did our environmental investigations. 00:21:44.130 --> 00:21:45.673 That was the oil and gas leak. 00:21:46.800 --> 00:21:51.800 But here you see also that is within a much larger red box. 00:21:51.960 --> 00:21:54.390 And that is about 120 acres. 00:21:54.390 --> 00:21:58.300 And that is actually an old water treatment facility. 00:21:58.300 --> 00:22:02.380 And so the city of Andrews wanted this site 00:22:02.380 --> 00:22:04.610 to be turned into a bird viewing Park, 00:22:04.610 --> 00:22:07.900 because apparently there's, so there's the sedimentation 00:22:07.900 --> 00:22:10.590 lagoons that are part of the water treatment facility 00:22:10.590 --> 00:22:13.000 that have really high organic content 00:22:13.000 --> 00:22:15.630 that support wildlife and vegetation. 00:22:15.630 --> 00:22:20.550 And the city of Andrews is also in this area that receives 00:22:20.550 --> 00:22:24.760 more than 30 bird species kind of flying over it. 00:22:24.760 --> 00:22:28.423 So you see tones of different birds in this area. 00:22:30.620 --> 00:22:35.120 And then as previously stated once the city of Andrews 00:22:35.120 --> 00:22:37.770 had successfully completed Railroads the Commission's 00:22:37.770 --> 00:22:41.360 Brownfields Program, they received grant funds 00:22:41.360 --> 00:22:43.630 from Texas Parks and Wildlife 00:22:43.630 --> 00:22:46.970 to develop those hiking trails and boardwalk. 00:22:46.970 --> 00:22:48.790 They have a beautiful boardwalk that looks out 00:22:48.790 --> 00:22:52.870 over these sedimentation lagoons with really nice scopes, 00:22:52.870 --> 00:22:56.443 just in case you forgot your binoculars at home. 00:22:59.010 --> 00:23:02.260 But the other really great part about this redevelopment 00:23:02.260 --> 00:23:07.137 plan is that this brownfield site was actually next to, 00:23:07.137 --> 00:23:10.870 it's an 80 acre property that the city of Andrews 00:23:10.870 --> 00:23:13.793 has recently developed into a sports complex. 00:23:15.701 --> 00:23:18.273 And this is in an area of the city of Andrews, 00:23:18.273 --> 00:23:22.030 it's kind of like selfies on sort of the outskirts 00:23:22.030 --> 00:23:26.220 of the city that previously just wasn't being utilized, 00:23:26.220 --> 00:23:28.950 there wasn't much to do in that area. 00:23:28.950 --> 00:23:32.127 And this has brought a tone of interest to this area, 00:23:32.127 --> 00:23:36.063 and is really kick-starting revitalization around here. 00:23:39.420 --> 00:23:42.340 Alright, so the next example. 00:23:42.340 --> 00:23:47.100 So this is actually, these are, it's gonna be an example 00:23:47.100 --> 00:23:49.560 with four redevelopment projects, 00:23:49.560 --> 00:23:52.740 two of which are Brownfield projects. 00:23:52.740 --> 00:23:57.620 So this is Nueces County in in Robstown, Texas. 00:23:57.620 --> 00:24:02.620 And the brownfields portion of this area is 67.5 acres. 00:24:06.220 --> 00:24:11.220 So prior to 2002 when Nueces County 00:24:12.532 --> 00:24:15.920 was starting to develop this property. 00:24:15.920 --> 00:24:18.300 It was undeveloped agricultural land 00:24:18.300 --> 00:24:21.203 that was previously used for oil and gas production. 00:24:24.680 --> 00:24:28.530 And so here, this is the same image you see on the left, 00:24:28.530 --> 00:24:30.900 but just from our GIS viewer. 00:24:30.900 --> 00:24:34.030 And you can see here that there was a lot of oil and gas 00:24:34.030 --> 00:24:38.693 activity in the area at one point in time. 00:24:39.570 --> 00:24:41.687 And so a lot of these wells have been plugged 00:24:41.687 --> 00:24:42.883 and abandoned though. 00:24:47.840 --> 00:24:50.000 Okay, so as I mentioned this is four 00:24:50.000 --> 00:24:52.440 different redevelopment projects. 00:24:52.440 --> 00:24:53.990 This was between 2002 and 2017. 00:24:55.830 --> 00:25:00.180 So we have a baseball stadium that was put in 2002, 00:25:00.180 --> 00:25:02.530 fairgrounds in 2008, and outlet mall, 00:25:02.530 --> 00:25:05.840 which is a brownfield in 2017. 00:25:05.840 --> 00:25:08.290 And then this water quality improvement project 00:25:08.290 --> 00:25:13.290 that's kind of up in the upper right corner. 00:25:13.480 --> 00:25:16.320 And I think here it's important to point out that the city 00:25:16.320 --> 00:25:19.660 of Nueces County actually did their own environmental 00:25:19.660 --> 00:25:23.210 investigation of this entire huge property 00:25:23.210 --> 00:25:25.630 with all four of these redevelopment plans. 00:25:25.630 --> 00:25:28.520 And the two areas where they found, 00:25:28.520 --> 00:25:31.900 that needed investigations were actually at the outlet mall 00:25:31.900 --> 00:25:34.200 and the water quality improvement. 00:25:34.200 --> 00:25:37.210 Nueces County was actually gonna fund the cleanup 00:25:37.210 --> 00:25:40.250 at those two sites before they realized 00:25:40.250 --> 00:25:42.430 that the Railroad Commission had funds 00:25:42.430 --> 00:25:44.550 that were available to them. 00:25:44.550 --> 00:25:48.040 So they were able to go ahead and develop 00:25:48.040 --> 00:25:50.670 the baseball stadium and fairgrounds 00:25:50.670 --> 00:25:53.610 while also being entered into the program 00:25:53.610 --> 00:25:57.983 for these two other sites. 00:26:01.150 --> 00:26:02.610 So here's just kind of a progression 00:26:02.610 --> 00:26:06.507 from 2014 to 2017 of this site. 00:26:06.507 --> 00:26:07.940 And you can just see over the years 00:26:07.940 --> 00:26:12.940 it's really developed into a gray area, 00:26:13.010 --> 00:26:15.803 and has brought a lot of amenities to that area. 00:26:18.280 --> 00:26:21.110 So this site entered in 2005, 00:26:21.110 --> 00:26:22.840 we did a phase one and phase two. 00:26:22.840 --> 00:26:25.630 We found a plugged oil and gas wells. 00:26:25.630 --> 00:26:28.220 We collected some soil samples and put them 00:26:28.220 --> 00:26:30.170 in temporary monitoring well. 00:26:30.170 --> 00:26:34.550 We had some hydrocarbons in soil about regulatory levels, 00:26:34.550 --> 00:26:35.950 which required to clean up. 00:26:35.950 --> 00:26:39.720 So we excavated those soils and disposed off off site. 00:26:39.720 --> 00:26:44.090 And then in 2008 Nueces County received their certificate 00:26:44.090 --> 00:26:47.563 of completion for this outlet mall property. 00:26:49.610 --> 00:26:53.920 And then water quality environmental investigations. 00:26:53.920 --> 00:26:56.853 So this one, they entered in 2015. 00:26:57.983 --> 00:27:00.640 And we found plugged oil and gas wells on that property, 00:27:00.640 --> 00:27:03.453 a drilling pit and a historical tank battery. 00:27:04.310 --> 00:27:09.310 There's hydrocarbons, and metals and chlorides and soils 00:27:09.679 --> 00:27:14.679 at this property that required additional assessment, 00:27:14.780 --> 00:27:16.940 which we did in 2016. 00:27:16.940 --> 00:27:20.280 And then we ended up installing permanent monitoring wells 00:27:20.280 --> 00:27:21.420 at this site. 00:27:21.420 --> 00:27:25.470 And groundwater monitoring is ongoing at the property. 00:27:25.470 --> 00:27:30.100 But right now we have benzene, arsenic and chloride 00:27:30.100 --> 00:27:31.483 in groundwater right now. 00:27:33.650 --> 00:27:35.090 Okay, so our last example 00:27:35.090 --> 00:27:37.890 is gonna be the Turtle Bayou Nature Preserve. 00:27:37.890 --> 00:27:42.410 So this is just outside of Houston in chambers County, 00:27:42.410 --> 00:27:44.683 and it's 511 acres. 00:27:47.690 --> 00:27:50.690 So the environmental investigations we did at this property, 00:27:51.710 --> 00:27:55.440 there are 10 abandoned oil wells on the property, 00:27:55.440 --> 00:27:58.357 there was some associated pits with those wells, 00:27:58.357 --> 00:28:00.090 some above ground storage tanks 00:28:00.090 --> 00:28:01.963 and some saltwater disposal pits. 00:28:03.370 --> 00:28:07.560 We sampled soil, groundwater and surface waters. 00:28:07.560 --> 00:28:11.380 So that surface water from the Turtle Bayou itself 00:28:11.380 --> 00:28:13.430 for petroleum products. 00:28:13.430 --> 00:28:17.270 Based on that phase two investigation we really focused 00:28:17.270 --> 00:28:21.960 in additional assessments on that saltwater disposal 00:28:21.960 --> 00:28:24.560 pit at the site, because there were some chloride 00:28:24.560 --> 00:28:26.613 contamination associated with it. 00:28:27.450 --> 00:28:31.160 And so we're continuing to monitor groundwater 00:28:31.160 --> 00:28:32.933 at this site for chlorides. 00:28:33.960 --> 00:28:37.920 And as a result of the saltwater disposal pit, 00:28:37.920 --> 00:28:42.050 and we also monitor surface waters within Turtle Bayou. 00:28:42.050 --> 00:28:43.890 So Turtle Bayou is a fresh water Bayou. 00:28:43.890 --> 00:28:47.670 And so we're constantly kind of monitoring that to ensure 00:28:47.670 --> 00:28:50.430 that there's no communication between 00:28:50.430 --> 00:28:54.153 the impacted groundwater and the freshwater in Turtle Bayou. 00:28:57.080 --> 00:28:58.410 And this site is really unique 00:28:58.410 --> 00:29:01.900 because it's has multiple funding sources. 00:29:01.900 --> 00:29:04.740 We're gonna get into this actually a lot more in eight, 00:29:56.330 --> 00:30:01.330 and that's cost us almost $500,000 to do so. 00:30:01.630 --> 00:30:03.633 And this is a great site where, 00:30:04.870 --> 00:30:06.690 this site would have never
